1. Acceptance of Terms

By accessing and using Oferz ("the Platform", "we", "us", or "our"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Platform.

These terms apply to all users of the Platform, including both customers who browse and redeem offers, and businesses who create and manage offers.

2. User Accounts

2.1 Account Registration

To access certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

2.2 Account Types

Customer Accounts: Free for all users. Allows browsing, saving, and redeeming offers.

Business Accounts: Available on Free, Basic, and Premium tiers. Allows creation and management of offers and loyalty programs.

3. Subscription Plans & Payments

3.1 Subscription Tiers

3.2 Payment Processing

Payments are processed securely through Stripe. We do not store your payment card details. By subscribing, you authorize us to charge your payment method for the selected plan.

3.3 Billing Cycle

Subscriptions are billed monthly on a recurring basis. Your subscription will automatically renew unless cancelled before the renewal date.

3.4 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Existing subscribers will be notified via email before any price changes take effect.

4. Offer Creation & Management

4.1 Business Responsibilities

Businesses using the Platform agree to:

• Create accurate and truthful offers
• Honor all published offers and redemptions
• Comply with all applicable laws and regulations
• Not engage in misleading or deceptive practices
• Verify customer redemptions promptly
• Maintain adequate inventory to fulfill offers

4.2 Offer Content

You retain ownership of your offer content but grant Oferz a non-exclusive license to display, distribute, and promote your offers on the Platform.

4.3 Prohibited Offers

Businesses may not create offers that:

• Violate any laws or regulations
• Promote illegal activities
• Contain offensive or inappropriate content
• Infringe on intellectual property rights
• Are fraudulent or misleading

5. Customer Use of Platform

5.1 Offer Redemption

Customers may redeem offers by generating a PIN code through the Platform. Each offer may only be redeemed once per customer unless otherwise stated. PIN codes are valid for 24 hours from generation.

5.2 Customer Conduct

Customers agree not to:

• Abuse or exploit the Platform or offers
• Share or sell PIN codes to others
• Use automated systems to generate redemptions
• Attempt to redeem expired or invalid offers
• Harass or abuse business staff

6. Loyalty Programs

Businesses on Premium plans may create loyalty programs. Each business sets its own loyalty program terms, rewards, and redemption requirements. MyOfferHub is not responsible for loyalty program fulfillment - this is the responsibility of the individual business.

Loyalty points and stamps have no cash value and cannot be transferred between businesses or users.

7. Cancellation & Refunds

7.1 Subscription Cancellation

You may cancel your subscription at any time through your account settings or the billing portal. Cancellations take effect at the end of the current billing period.

7.2 Refund Policy

We offer a 14-day money-back guarantee for first-time subscribers. After 14 days, subscriptions are non-refundable. Partial month refunds are not provided upon cancellation.

7.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms. No refunds will be issued for accounts terminated due to violations.

8. Intellectual Property

The Platform, including its design, features, and functionality, is owned by Oferz and protected by copyright, trademark, and other intellectual property laws.

Users retain ownership of their content but grant Oferz a worldwide, non-exclusive license to use, display, and distribute such content for the purpose of operating the Platform.

You may not copy, modify, distribute, sell, or lease any part of the Platform without our express written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFERZ SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Disputes between customers and businesses
• Quality, accuracy, or availability of offers
• Failure of businesses to honor offers
• Unauthorized access to user accounts

Our total liability shall not exceed the amount paid by you in the past 12 months, or £100, whichever is less.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of accuracy, reliability, or completeness
• Warranties that the Platform will be uninterrupted or error-free
• Warranties regarding third-party content or services

11. Indemnification

You agree to indemnify and hold harmless Oferz, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit to the Platform

12. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

We comply with GDPR and UK data protection laws. You have the right to access, correct, or delete your personal data at any time.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Platform at least 30 days before taking effect.

Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
